California Coastal Commission Hears Project Amendment

Thursday October 10, 2013 the CCC will hear a proposed amendment to the Coastal Development permit for the sewer project. The Executive Director deems the amendment as immaterial and recommends that the change as it is consistent with the original CDP approval. However, if objections are received, the amendment won't be passed unless three Commissioners agree to the immateriality of the of the Executive Director's determination. If they do not, the application shall be processed as a Material CDP amendment.

CCC Proposes Permit Amendment

Dated September 26, 2013, the proposed amendment to the Coastal Development Permit (CDP) would allow for the standby power building associated with the Lupine Pump Station to be relocated to a parcel with a greater distance from wetlands, where no tree trimming or removal would occur and that has no suitable habitat for the endangered Morro shoulderband snail. The amendment would also amend Special Condition 4 to allow the recordation of the required easement to occur prior to the operation of the treatment plant rather than prior to the construction of the plant.

This letter arrived in the mail on Friday, September 27. The Commissions reference number for the proposed amendment is A-3-SLO-09-055/069-A2.



The Executive Director has determined this change to be immaterial as it is consistent with the Commission's original CDP approval, the certified LCP, the Coastal Act's access and recreation policies.

Los Osos Sewer Project Safe

The request for revocation of the permit for the Los Osos sewer project by the Los Osos Sustainability Group was DENIED by the California Coastal Commission today. Let's hope that is the last such obstacle to getting this project built. The phrase, "We Delay, We Pay," has come true every time a project was delayed or stopped. Although the monthly payments this time round are scaled back, the years to pay have stretched out longer.

I wonder how much staff time and money LOSG is responsible for on the cost of this project that we all are paying for? It is wonderful that we can all express our opinions about this and other issues, but at what point should these opinions be expressed only in venues that don't add to an already hefty financial burden on the community? Sorry Board of Supervisors, I know that this means you.

Thanks to Mr. Ogren, Mr. Waddell, Mr. Hutchison, and county staff who worked on this and our District 2 Supervisor Mr. Gibson for representing the majority of the community in Huntington Beach today. Have a safe trip home.

1:54 p.m. Coastal Commission Concurs!

The California Coastal Commission agreed with staff to the amendment to the Los Osos Coastal Development Permit to move the generator building to be located in the community park over to the library across the street.

The Deputy Director's Report lists this as an "Immaterial Amendment." And no commissioners disagreed with that assessment. This knocked down concerns about library space (a slide showed where the new expansion would go if there was to be one someday), noise (as quiet as a conversation), habitat impingement (U.S. Fish & Wildlife Service gave a green light), the CSD well in the parking lot (no problem), improper noticing (400 letters mailed plus a sign noticing what was to happen well in advance of this hearing, and that prior conditions from the last project should be imposed on this project (that was a different project whose permit had expired).

Four commissioners had ex-parte conversations with Bruce Gibson on the topic of performance deadlines associated with funding that might be a problem should the commissioners not agree with staff.

No delay to the project today however so the project moves ahead. My thanks to Bruce Gibson for helping Los Osos avoid costly delays.

Sneaky, Sneaky, Sneaky

Today my public records request from the California Coastal Commission arrived. It's happening again in 2012 as it did in 2005.

People who don't like the sewer project that the County is building have decided to go behind the backs of the rest of the community and are attempting to have pulled the Coastal Development permit that the California Coastal Commission granted to the project. No permit and the project can't move ahead.

I find this subterfuge sneaky and dangerous. I find this action arrogant, as if they were telling the community, "we know what's best for you, your poor decisions don't count, what you want doesn't matter —because WE ARE RIGHT." Did anybody ASK the rest of us if this is what we wanted? NO. They're just going ahead with endangering the project's funding and our credibility with all of the relevant agencies.

Details to follow in subsequent posts, I am so mad I can't type well right now.

The PZLDF appeal has moved forward. You might recall that this group's continuation to an appeal of their lost case is what is keeping the CDOs in place on 45 or so homes in Los Osos.
